These Terms and Conditions ("Terms") govern your use of www.ausrugs.com.au (the "Site") and your purchase of rugs and related products through the Site.

The Site is owned and operated by Australian Rugs  ("ausrugs.com.au", "we", "us", or "our"). The Site is an online retail store that sells rugs and related products to customers throughout Australia.

By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you should not use the Site or purchase products from us.

These Terms are subject to your rights under the Australian Consumer Law (ACL). Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified.

1. Intellectual Property

All content published or made available on the Site is owned by or licensed to Australian Rugs and/or its content creators. This includes, but is not limited to, product images, photographs, text, product descriptions, logos, graphics, designs, documents, downloadable files, and other materials that form part of the Site.

You must not reproduce, copy, modify, distribute, publish, transmit, or otherwise use any content from the Site without our prior written permission, except where permitted by law.

2. Products and Sale of Goods

Australian Rugs is an online rug retailer offering a wide range of rugs and related products to customers throughout Australia.

Our products may include, but are not limited to:

     Area rugs

     Floor rugs

     Modern rugs

     Contemporary rugs

     Traditional rugs

     Persian-style rugs

     Oriental-style rugs

     Runner rugs

     Round rugs

     Outdoor rugs

     Indoor rugs

     Shag rugs

     Kids' rugs

     Machine-washable rugs

     Hallway and entry rugs

     Living room rugs

     Bedroom rugs

     Dining room rugs

     Office rugs

     Large rugs

     Small rugs

     Custom or specialty rugs, where available

     Other rug styles, sizes, materials, designs, and related home décor products available on the Site

We aim to ensure that product descriptions, dimensions, colours, images, and other information displayed on the Site are as accurate as reasonably possible.

However, colours may appear differently depending on your device, screen settings, lighting, photography, and other factors. Minor variations in colour, texture, pattern, or appearance may also occur due to manufacturing processes and the nature of individual rug materials.

Product dimensions are provided as a guide. Minor variations in size may occur due to manufacturing, finishing, and production processes.

We reserve the right to correct any errors, inaccuracies, or omissions on the Site, including product descriptions, pricing, availability, and other information, at any time without prior notice. This does not affect your rights under the Australian Consumer Law in relation to an order already accepted.

Product availability may change without notice. If a product becomes unavailable after you have placed an order, we will contact you where reasonably possible and may offer an alternative product or provide a refund for the unavailable product.

3. Orders

When you place an order through the Site, you are making an offer to purchase the selected products in accordance with these Terms.

An order is not accepted until we have confirmed the order and/or dispatched the products, unless otherwise stated.

You may request to amend or cancel an order before it has been dispatched by contacting us. We will accommodate such requests where reasonably possible.

Australian Rugs reserves the right to refuse, cancel, or limit an order, acting reasonably, where:

     A product is unavailable

     There is a genuine error in the product description or price

     We suspect fraudulent or unlawful activity

     The order contains incorrect or incomplete information

     We are unable to fulfil the order for reasons beyond our reasonable control

     The order otherwise breaches these Terms

If we cancel an order after payment has been processed, we will provide a full refund of the amount paid for the cancelled products within a reasonable time.

You are responsible for checking your order details, including product selection, size, colour, quantity, delivery address, and contact details, before completing your purchase.

4. Pricing

All prices displayed on the Site are in Australian dollars (AUD) and, where applicable, are inclusive of Goods and Services Tax (GST).

Prices may change from time to time without notice. A price change will not affect an order we have already accepted, except where the order is cancelled due to an obvious pricing or listing error.

Australian Rugs reserves the right to correct genuine pricing errors or inaccuracies.

If a product has been purchased at an obviously incorrect price due to an error, we will contact you to confirm whether you wish to proceed at the correct price or receive a full refund. You will not be charged the incorrect price without your agreement.

Delivery and shipping charges, where applicable, will be displayed during checkout or otherwise communicated to you before your order is completed.

5. Payment

We accept payment methods displayed on the Site at the time of purchase. These may include:

     Credit cards

     Debit cards

     PayPal

     Afterpay

     Zip Pay

     Other payment methods made available through our payment providers

By providing payment information, you authorise Australian Rugs and/or our payment service providers to process payment for your order.

Payment processing may be handled by third-party payment providers. Australian Rugs does not generally have access to your complete payment card details.

If we reasonably believe that a transaction is fraudulent, unlawful, unauthorised, or otherwise violates these Terms, we may cancel or reverse the transaction, subject to applicable law.

6. Shipping and Delivery

Australian Rugs provides online rug sales with delivery available across Australia, subject to delivery locations and carrier availability.

We aim to offer Australia-wide shipping for products available for delivery through our Site.

Delivery options and estimated delivery times will be displayed or communicated at the time of purchase.

Estimated delivery times may vary depending on:

     Your delivery location

     The size and weight of your order

     The rug or products purchased

     The delivery service selected

     Product availability

     Carrier capacity

     Circumstances outside our reasonable control

Estimated delivery times are not guaranteed unless expressly stated otherwise. Delivery times generally refer to business days and may exclude weekends and public holidays.

We are not responsible for delays caused by circumstances beyond our reasonable control (force majeure), including extreme weather, natural disasters, transport disruptions, carrier delays, strikes, government restrictions, road closures, or other unforeseen events. This does not affect any right you have under the Australian Consumer Law where a product itself is faulty or not as described.

You are responsible for providing a complete and accurate delivery address and contact details.

If you provide incorrect or incomplete delivery information, additional delivery charges may apply, and delivery may be delayed.

Where a delivery address is incorrect or incomplete due to information supplied by you, Australian Rugs will not be responsible for any resulting delivery failure, loss, or additional costs, to the extent permitted by law.

7. Delivery Charges

Delivery charges may apply depending on your location, order size, product dimensions, delivery method, and any applicable promotional offer.

Any applicable delivery charges will be displayed at checkout or otherwise communicated to you before you complete your purchase.

Free delivery promotions, where offered, may be subject to specific conditions, exclusions, locations, product types, or minimum order requirements, which will be clearly stated.

Delivery charges may vary between metropolitan, regional, rural, and remote areas of Australia.

Where additional delivery charges apply to certain locations or products, Australian Rugs will communicate these charges where reasonably possible before completing your order.

8. Delivery to Remote and Regional Areas

Australian Rugs aims to provide delivery throughout Australia. However, delivery availability, delivery methods, and delivery charges may vary for regional, rural, remote, island, and other locations.

Some remote or difficult-to-access locations may be subject to additional freight charges or delivery restrictions.

If additional delivery charges apply after an order has been placed, Australian Rugs will contact you to discuss the additional cost before dispatch.

If you do not wish to proceed with the additional delivery charge, you may cancel the affected order and receive a full refund of amounts paid for it.

9. Authority to Leave and Delivery

Where available, you may be able to select an "Authority to Leave" or similar delivery option.

If you provide authority for a delivery carrier to leave your order at your nominated location, you acknowledge that the carrier may leave the goods without obtaining a signature.

You are responsible for ensuring that the nominated delivery location is reasonably safe and suitable for leaving the goods.

Australian Rugs is not responsible for loss or damage occurring after delivery has been completed in accordance with an Authority to Leave instruction, except where otherwise required by law. This does not limit or exclude any rights you may have under the Australian Consumer Law.

10. Inspection of Goods

We recommend that you inspect your rug as soon as reasonably possible after delivery.

If your product arrives damaged, is faulty, is significantly different from its description, or is not the product you ordered, please contact Australian Rugs as soon as possible with details of the issue and, where appropriate, photographs of the product and packaging.

We may request reasonable information or evidence to assess your claim.

You should keep the original packaging where reasonably possible until any issue with your order has been resolved.

11. Refunds and Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, or other remedy where a product does not meet a consumer guarantee. For example, a remedy may be available where a rug:

     Is faulty or damaged

     Is significantly different from its description

     Does not match a sample or demonstration model, where applicable

     Is not fit for a purpose that you made known to Australian Rugs

     Does not meet another applicable consumer guarantee under the Australian Consumer Law

Your legal rights under the Australian Consumer Law are not affected by our store policies.

If you believe that a product has a fault or does not meet a consumer guarantee, please contact Australian Rugs with details of the issue. We may assess the product and request reasonable information to determine the appropriate remedy.

Where a product has a major failure under the Australian Consumer Law, you may choose between a refund or replacement. Where a product has a minor failure, Australian Rugs may choose to provide a repair, replacement, or other remedy within a reasonable time, in accordance with the Australian Consumer Law.

12. Change of Mind Returns

Subject to the Australian Consumer Law, Australian Rugs may accept returns for change of mind at our discretion and in accordance with any applicable returns policy published on the Site.

Change-of-mind returns may be subject to conditions, including:

     The product must be unused and in saleable condition

     The product must be returned within the applicable return period

     The product must be in its original packaging, where reasonably possible

     The customer may be responsible for return shipping and other applicable costs

Change-of-mind returns do not affect your rights under the Australian Consumer Law.

Australian Rugs is not required to provide a refund, replacement, or exchange for a change of mind unless required by law or otherwise stated in our applicable returns policy.

13. Returns

Where a return is approved, Australian Rugs will provide instructions on how and where to return the product.

Returns may be accepted by arrangement at our nominated location or through an approved return delivery method.

Please contact Australian Rugs before attending the returns location to confirm the return process and operating arrangements.

Customers should not return products without first contacting us where prior approval is required.

The cost of returning a product may depend on the reason for the return and whether the return is being made under the Australian Consumer Law or as a change-of-mind return.

Where a product is returned because of a fault or failure covered by the Australian Consumer Law, Australian Rugs will meet the reasonable postage or transit costs of the return, and will meet its other obligations in accordance with applicable law.

14. No Unauthorised Replacement

Australian Rugs does not provide automatic replacements for products unless the circumstances meet the requirements of our returns policy or the Australian Consumer Law.

Where a product is faulty, damaged, incorrectly supplied, or otherwise covered by a consumer guarantee, Australian Rugs will provide the remedy required by law, which may include a repair, replacement, refund, or other appropriate remedy depending on the circumstances.

15. Accounts

If you create an account on our Site, you agree that:

     You are responsible for maintaining the security and confidentiality of your account login details

     You are responsible for activity carried out through your account

     The personal information you provide is accurate and up to date

     You will update your information when it changes

You must notify Australian Rugs if you believe your account has been accessed without your authorisation.

Australian Rugs reserves the right to suspend or terminate an account where reasonably necessary, including where the account is used unlawfully or in breach of these Terms. Where reasonably possible, we will provide you with notice and an opportunity to resolve the issue beforehand.

16. Privacy

Australian Rugs is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect personal information — such as your name, contact details, delivery address, order history, and payment-related information — to process your orders, manage your account, respond to enquiries, and improve our products and services.

We do not sell your personal information. We may share your information with trusted third parties where reasonably necessary to fulfil your order, including payment processors, delivery carriers, and IT service providers, who are required to handle your information securely.

For further information about how we collect, use, store, and disclose your personal information, including how you may access or correct your information or make a privacy complaint, please refer to our Privacy Policy published on the Site.

17. Electronic Marketing Communications

If you consent to receive marketing communications from us, we will only send these in accordance with the Spam Act 2003 (Cth). You may opt out or unsubscribe from marketing communications at any time using the unsubscribe link provided or by contacting us directly.

Transactional communications relating to your order, such as order confirmations, dispatch notices, and delivery updates, are not marketing communications and will continue regardless of your marketing preferences.

18. Consumer Protection Law

These Terms are subject to the Australian Consumer Law, including Schedule 2 of the Competition and Consumer Act 2010 (Cth), as well as any other applicable Australian consumer protection legislation.

Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, remedies, or obligations that cannot lawfully be excluded, restricted, or modified.

If any provision of these Terms conflicts with a mandatory requirement of applicable consumer protection legislation, the mandatory requirement will prevail to the extent of the inconsistency.

19. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law, or any other right or remedy that cannot lawfully be excluded, restricted, or modified.

Where you are acquiring goods or services other than of a kind ordinarily acquired for personal, domestic, or household use or consumption (for example, for trade or business purposes), our liability for a failure to comply with a consumer guarantee is limited, at our option and to the extent permitted by section 64A of the Australian Consumer Law, to one or more of: replacing the goods or supplying equivalent goods; repairing the goods; paying the cost of replacing the goods or acquiring equivalent goods; or paying the cost of having the goods repaired.

Subject to the above, and to the maximum extent permitted by law, Australian Rugs and its directors, officers, employees, agents, contractors, affiliates, and service providers will not be liable for indirect, special, or consequential loss arising from your use of the Site or purchase of products.

Nothing in this clause limits or excludes liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

20. Indemnity

To the maximum extent permitted by law, and only to the extent reasonably necessary to protect our legitimate interests, you agree to indemnify Australian Rugs, its directors, officers, employees, agents, and contractors against direct loss, liability, or reasonable expense we incur as a result of your unlawful conduct, fraud, or breach of these Terms.

This indemnity does not apply to the extent that the relevant loss or liability was caused or contributed to by Australian Rugs' negligence, breach of these Terms, or any conduct that cannot lawfully be excluded or limited.

21. Applicable Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

You agree that the courts of Victoria, Australia, will have jurisdiction in relation to disputes arising from or relating to these Terms or your use of the Site, subject to any rights you may have under applicable consumer protection laws.

22. Dispute Resolution

If you have a concern or dispute regarding your order, product, delivery, return, or our services, we encourage you to contact Australian Rugs first so that we can attempt to resolve the matter directly and in good faith.

Nothing in this section limits or excludes your rights to make a complaint to a relevant consumer protection authority (such as the ACCC or your state or territory fair trading body) or to pursue any legal rights or remedies available to you under Australian law.

Any dispute resolution process will be subject to applicable Australian law and will not prevent a consumer from exercising rights or remedies that cannot lawfully be excluded.

23. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable, where possible.

If the provision cannot be made valid or enforceable, it will be removed to the extent necessary, and the remaining provisions of these Terms will continue to apply.

24. Changes to These Terms

Australian Rugs may update or amend these Terms from time to time to reflect changes in our business, products, services, website operations, or legal requirements.

The updated Terms will be published on the Site with a revised effective date. Changes will not apply retrospectively to orders placed before the updated Terms take effect.

Where required by law, Australian Rugs will provide notice of material changes in an appropriate manner.

Your continued use of the Site after updated Terms are published constitutes acceptance of the revised Terms, to the extent permitted by law.
